Bank of China is one of the five largest state-owned commercial banks in the People's Republic of China. Our capital markets team advised this prestigious client in the issuance, in December 2017, of ZAR 350 million unsecured floating rate notes on the Interest Rate Market of the JSE. The issuance was made under the Bank of China’s ZAR 15 billion domestic medium term note programme.

In the Labour Appeal Court (LAC) case of Passenger Rail Agency of South Africa and Others v Ngoye and Others [2024 45 ILJ 1228 (LAC) the LAC affirmed the that the dispute resolution procedures in the Labour Relations Act 66 of 1995 (LRA) do not defeat an employee’s right to rely on the common law contractual recourse, provided that the applicant pleads their case on this basis, as the right to not be unfairly dismissed is not the only right that may be implicated as a result of a dismissal.

The Constitutional Court dismisses the Minister’s application for leave to appeal ZEP judgment

On 28 June 2023, the High Court declared the decision by Dr Aaron Motsoaledi, the former Minister of Home Affairs (Minister), to terminate the Zimbabwean Exemption Permit (ZEP) unlawful, unconstitutional and invalid. This decision concerned the rights of over 178,000 ZEP holders. As a consequence, the court remitted the matter back to the Minister for reconsideration following a fair process in accordance with the Promotion of Administrative Justice Act 3 of 2000 (PAJA).
